PARTICIPATION, RELEASE AND WAIVER AGREEMENT
In consideration of the acceptance of my (our) participation in AKC Agility League Championship, November 5th-8th, 2026, held at the James B. Hunt Horse Complex, Raleigh, North Carolina (the “Event”), I (we) agree [to abide by the rules and regulations of The American Kennel Club (“AKC”) and/or James B. Hunt Horse Complex, in effect at the time of this Event, and any additional published rules and regulations and any decision made in accord with them. I (we) agree that the AKC and/or James B. Hunt Horse Complex, has the right to refuse to allow my (our) participation as AKC and/or James B. Hunt Horse Complex, deems sufficient. I (we) certify that I am (we are) the actual legal owner(s) of the dog, whose name and information I (we) have entered above and that the dog is properly licensed and vaccinated in accordance with North Carolina law. I (we) certify and represent that the dog entered is not a hazard to persons or other dogs.
In consideration of the acceptance of my participation and of the holding of this Event and of the opportunity to participate, I (we) will indemnify, defend and hold AKC, James B. Hunt Horse Complex, and any of their parents, affiliates, subsidiaries, employees, officers, directors, or agents; any provider of services that are necessary to hold this event; the event-giving club; any AKC approved judge, judging at this Event; and any volunteers of the aforementioned parties (“Indemnitees”) harmless from (“Indemnify”) any and all claims, costs, liabilities, judgments, expenses or damages (including reasonable attorneys’ fees) (“Costs”) (i) arising out of any breach of this Agreement or any representation I (we) made herein; and (ii) any actual or alleged physical damage to tangible property (including my dog) and/or personal injuries, including death, to any person (including me (us)), or the alleged negligent act(s) or omission(s) or alleged willful misconduct by me (us).
I (we) give irrevocable permission to AKC, its affiliates, clients, assignees, and licensees and [insert any entity who will be using the name/likeness] to use my name, voice, biographical information, performance and likeness (“name/likeness”) and the name/likeness of my dog, in photographs, portraits, pictures, electronic or digital images, tape, film, video footage, television, live-stream and all reproductions thereof in any form whatsoever, completely or in part for any production of AKC and/or is affiliates, its clients, assignees and licensees and [[insert any entity who will be using the name/likeness]; to copyright such productions; to distribute such productions publicly in may manner whatsoever; and to issue and authorize publicity concerning such productions.
I (we) agree that all photographs, portraits, pictures, electronic or digital images, tape, film, video footage, television, live-stream and all reproductions thereof in any form whatsoever (“the Materials”) of me (us) used and taken by AKC at the Event are owned by AKC, and AKC is the owner of all copyrights in same. I (we) acknowledge that I (we) have no right or interest in the Materials, nor any right to nor any interest in any copyright therein. If I (we) should receive any print, negative or copy thereof, I (we) shall not use or authorize its use by anyone else.
I (we) agree that the Materials’ use need not be submitted to me for approval and that AKC, its affiliates, licensees, agents and assignees and others working for it or on its behalf shall be without liability to me for any distortion or illusionary effect resulting from the creation, publication or broadcast of the event. I (we) hereby waive any rights and any and all claims arising under the Visual Artists Rights Act, 17 U.S.C. 106A, and any comparable state or local law, as amended from time to time, with respect to the Image. I (we) further agree that I (we) shall have no claim to any compensation.
I (we) hereby warrant that I am (we are) 21 years of age or older, and have the right to enter into this agreement and grant the rights hereunder.
